Where does the mandate start and stop? How do we place importance and limits?

An institution

I have been put into an institution since 28 years old.  For this reason it is considered a given.  People assume that I am happy with this arrangement. In other words there is no attempt to change the situation.  I am working to change this situation but because the institutions that I have been placed in believe in personal poverty. For example there is no way that I can amass personal possessions. This was the same in the home I was in before. How can I leave a heritage if I cannot cultivate a home?  It is an uphill battle. No matter what I have or what I am given I have to get rid of it in very little time.

For example I have no possessions left to me from my father. My father left his music tapes to me and my brother refuses to give them to me for that reason .My mother has a box of photographs of me and I told her not to give it to me because they will be lost. . I want to have access to a real estate agent to start a research for me a secure place with the possibilities to not get deprived of everything including my free will

At this point there is a question of, upon my mother’s decease, that the estate will be divided equally between the two heirs which are only myself and my brother.  I do not believe that there will be any way I can use the estate to find a real estate agent to get me to a desirable living condition.  I also believe that my brother who will be in charge of the estate, will use the whole estate to nurture his family and their style of living.  For example, the money of the estate will be used for the children’s education, for repairs to the country house which only they use, etc.  How will this change if I sign a mandate?  Can the situation be used to engage a financial counsel for myself to deal with situations such as this?

 

My collection

To me it is very important to have a collection of articles that ii can say are mine. All these institutions do not have a place for it. Since I live in a miniscule place all the stuff I have is very important.  So if I want to enjoy a change all immediately has to be given to total strangers: clothes, pictures are thrown out, articles of decoration, linen, jewels all are distributed to unknown people.  

It is not at all comforting to me to have my stuff used by the house and owned by it if they do not place any importance on it.  Even if they do.

Not married so I am used exploited as a member of my brothers family

Funds to go to Place des Arts

When my father was alive I was given funds to go to Place des Arts to enjoy the Pallet, opera and symphony orchestra. The reasons for this was to:

a.       Stop my social isolation

b.      Stop being too immersed in poverty

When my father died he said that there would always be money for me to go the Place des arts and attend high culture.  However, I was, at that time, forced to stop due to health reasons. The health reasons had to do with problems of proper nutrition before performances, transport, the healing of wounds that cannot be cured without the proper funding, and the opportunity to refresh and rest as needed before a difficult and tiring high cultural performance. The money had previously gone to Place des arts was to go to buying a comuter system so that I could work from home to achieve a high enough financial position to let me regain my health, and my social position.

The money being properly regulated

Part of The money destined to Place des arts is now being used partially to buy internet access for my small computer.  A larger part however remains unused by myself.

Can the mandate include a Claus that will destine the money left for Place des arts, to a controlled fund that will ensure its active use by myself to?

Regain my social activities, and combat social isolation and too much immersion in poverty.

And once this is done, to properly and safely continue them.

And could this sum given to me be formally indexed to be adjusted to the rising inflation rate.  Also can the unused monies for this fund be used retroactively, for some use, perhaps to engage a personal financial council for my family affairs?

Familial Violence

Often extreme the attacks persuaded on myself and others for personal gain have often been exceptionally brutal. Among these violent attacks one can include:

Kidnappings to maximum security prisons in the USA

Murder attempts

Theft and extortion

Controlling and painful over medication

Brain damaging

The attacks in the past, often aided by important members of society, can only lead me to assume that given very little problem of enacting this violence, and seeing the high level of competiveness among family members, it is inevitable they will occur again. Especially if money is involved.   Certainly there is no reason to assume that the family estate, if left to the management of my brother, in my case, will in any way go to me.  Unless this is clearly regulated and defined for the two heirs, both myself and my brother. Can this be done in a mandate?

My Brother Portion of the Family Estate

I must state that my brother’s position as a family father does not entitle him to a larger share of estate moneys.  On the contrary hits resulting affluence from having a family and a wife with a salary is also much more than mine and therefore his need, much less.  Therefore I do not feel that, he other members of his family should be a justification for my brother, who is the only heir besides me, to have a larger sum of estate monies.

Can this be stated in the mandate?

 If my brother has in the past taken money from the family estate in large amounts, for other members of his family, like for education or camp, than this money should be returned and with interest.

If my brother or any part of his extended family has aided and abetted another person to take a significant amount of the family estate, like stocks and bonds, than this should be returned and with interest.

If my brother or any part of his extended family, has taken by force, money destined for me and split it between this themselves, than this should be returned and with interest.

As a notary you have access, to a list

As a notary, I understand that you have access, to a list that states the name of my father’s notary at the time his last will was read. Ca you give me the name of his notary so that I can request, as a named beneficiary, a copy of the will for myself?

I would like to take steps necessary to improve my residence to better suit my needs and to prepare for my retirement.  I have been informed by my council that as a named beneficiary I have a right for a copy of the will and that it would be necessary for me to have this document in order that I might begin to put my affairs in order and find a residence better suited for my financial ambition, my collections and work, and my personal preferences.

I would Ned a copy of the will to help me effectively conduct any activity that concerns my health and my retirement.

I have read that a mandate can include instructions on the use of certain drugs. You can instructions as to which long term residence you prefer to be sheltered in

I would like to have each year a copy of the company’s annual report and audit as a part owner of this company.  I would also like to have an official record of the exact value of the assets that I am entitled to and this on a bi-yearly or quarterly basis.  I would like to have a biannual patrimonial report: a report that states any changes or improvements on the person who has the mandate controlling my affairs in case of trouble. I would like the name and address of the financial institution that handles the company’s assets and safety deposit box of family assets.  I would like a list of the value of the

Factory in St. Henri.  The cost of repairs in the two houses that I own: the country and the city house.

I would like to have a replacement named to replace the holder of the mandate and I would like to know the name.  I want it clearly stated that I do not want to be subjected once again to constraining drugs and if I am forced to take them I would like the reason why written down clearly and given to me.

The reason I would like the money issues clearly stated is because it is note being used to solve the problems that I encountered with transport, fatigue and refreshments.

I would like the family monies and the council to give me the monies to have a financial advisor handling my part of the family affairs.

Can the money be clearly defined as to what we are talking about and what sum is being directed to my needs and to my brother’s needs?

If inflation goes up each year I would like the money that I receive be automatically indexed with this.  This has not been done in the past and I would like the money that I have not received to be given to me retroactively.  We are talking about a sum of several hundred dollars that have not been given to me.
