Questions about the Mandate. Revision 2

Update February 23, 2015:

This document was originally published a while ago  But life goes on and as is natural, I am facing issues with the "Mandate".  The mandate, as it was referred to, was the assigned of the Power of Attorney to my brother. This has been done and paid for and the proper authorities as far as I know have been notified.  As a matter of fact all concerned have just been notified.  So, I grimly take out the contract that I signed.  It is a standard contract and I have difficulty just understanding it.  As for defending myself and the family against any misunderstandings and  making the contract work in the best possible manner I can, I don't even know where to begin. 
So, since my funds are non-existant, I once more look to the free available sources to get legal counsel.  the last time I did this I was confronted by two issues.  either I found a lack of concern about my understanding of the issues.  Or perhaps an incapacity to even know where to begin to explains the issues involved. And this before any potential inflammatory legal procedings.
A second thing that I found was a great unconcern for any importance placed on financial concerns.  where I am, still, mostly my counsel, actually felt, unlike me, that financial concerns were not relevant to one, like me, who asks for free legal counsel.
So I have an appointment with yet another counsel this week, and I dust off the documents I have to show them.  At least I will have something for people to read after I leave, at their own leisure if they care to. 
First challenge.  To see how good a translation Google provides.  Because I am still searching with nothing settled I am loathe to spend an over abundance of time of  an unknown.  So it is Google translation for now.  Which I am delighted they have one.  But it is imperfect, especially at first.  With more clicks and more attention, the quality of the translation will improve they say.  Obviously they too, like myself, have concerns about time and payment.

1. A Reading of the Will

There was a reading of the will.  I was informed by my father that the estate would be cleanly divided into two between me and my brother.
The estate is made up of many valuable things. For example, the country house was designed by Douglas Cardinal, the same man who designed the prize winning Museum of Civilisation in Ottawa.  He was chosen as a compliment to the population of the same origins living in the district.  The city house contains a very expensive collection of antiques and collectibles.
             I left my family home under very bitter circumstances.  At the time, knowing the family and the community, I was sure that I would be forced to come back to the family situation, greatly impoverished, through the means of hypocrisy and force.  It was to avoid more undue coercion that Cardinal was chosen even though his services were very expensive.  Eventually the house, being very important to the community because of its architect, would have a value far superior to the everyday needs of the family that still uses it. 
             I remain on the poverty line and I have been living on the poverty line ever since I left my family homean institution. The estate is worth a large sum of money. I would like to start solving my situation right now by looking into a suitable place to live.
For these reasons, I would like the estate (including both houses) to be liquefied and the proceeds to be split between my brother and me.
I would like access to a financial council handling my part of the family affairs.
I would like to know specifically the value of the various elements of the estate and I would like this on a written contract and updated yearly with the annual audit of the company and the government estate evaluation. I would like the name and address of the financial institution that handles the company’s assets and safety deposit box of family assets.
I would like to have access to conditions that would lead to a fair, just and high evaluation of the estate. 

Question:  Do you, the notary handle this? Should we decide how this will be enforced now? I f not How will this be taken care of? Can you suggest the names of experts who will be able to do it?

 

2.  My Company; the (Unnamed Company)

I have my own art company registered at the city hall and I continue to produce and collect art. I have a great deal of difficulty to hang on long enough to market my line.
For now, I would like another room in my residence as an office.  I currently work out of my tiny bedroom.  It is very demoralizing. (The price for another room in the residence is about $560.00 a month, all included)
I want access to a quality computer system with software for artists, an art lawyer, and a copyright for my work, contracts, a librarian, permanent storage space and a financial advisor.

Question:  Does the notary have the resources to improve the situation? If not, does the notary have the resources to delegate funds to have the situation improved when I receive the estate?

3. A copy of the will for myself

I did not ask for a copy of the will at the time of the reading.  As a notary, I understand that you have access, to a list that states the name of my father’s notary at the time his last will was read

Question:  Can you give me the name of my father’s notary so that I can request, as a named beneficiary, a copy of the will for myself?  Or can you as a notary give me a copy of the will?

4.  anA Proper Living Arrangement

I do not do housework. I do not cook.  I would like to live in a residence with these services.  But I do not want to live in a tiny room like I do. 
I am an adult and I am extremely uncomfortable in a twin bed.  I would like a room that comfortably fits at least a queen size bed.

Question:  Do you, the notary handle this? Should we decide how this will be done now? I f not How will this be taken care of? Can you suggest the names of experts who will be able to do it?

5. Personal poverty.

 
28 years oThe institutions that I have been placed in believe in personal poverty. They place no importance on material possessions such as art and design.   Since I live in my miniscule living working studio all articles take up important space. So loss is routine. Personal effects are thrown out, articles of decoration, linen, clothes and jewels all are distributed to unknown people
I am unable to accept an inheritance from my parents such as my father’s music tapes and my mother’s photographs.   The same is true for a complex estate of valuables and my own fairly large collection of art.

Question:  Can I demand with the mandate access to a real estate agent to start a research for me a secure place with the possibilities of keeping and nurturing an art collection, a household and healthy living arrangements?F

6. Fund for Place des Arts

When my father was alive I was given funds to go to Place des Arts to enjoy the performances and also to:
a.      Stop my social isolation
b.      Stop being too immersed in poverty
When my father died he said that there would always be money for me to continue this.  However, I was, at that time, forced to stop due to health reasons. A large part remains unused by myself.

Question:  Can the mandate include a Claus that will regulate the money left for Place des arts, to ensure its continued use by myself, and automatically indexed to inflation?

 Question:  Can the unused monies for this fund (since my father’s death) be used retroactively?

 

7.      Health Issues

I also several unhealed medical problems.  I have less than quality glasses, I receive an eye examination every three years in a hospital situation.  I have trouble with my ears. I cannot speak properly. I only think aloud. (I free associate).  I would like a therapist.
I would like access to a proper hairdresser and a spa on a regular basis.  I would like to have the money to go to a dermatologist yearly and an ear, nose and throat specialist. I would like to have an examination by a bone specialist on a yearly basis.
I would like guaranteed access to an exercise facility year round.  I do not have the ability to go to a skating ring or a gym membership in the winter
I have not been on a vacation in years. And for decade I have not been anywhere for two weeks.  I would like access to a vacation spot for special people like myself, a guaranteed safe one, according to my preferences, at least twice a year if not more.
 
You can also leave instructions in the mandate for council to restrict the use of painful, controlling drugs and actively look into long term residences. Now, before any trouble.

Question:  Can the notary indicate that funds should be used to regulate these lacks with proper, qualified and accessible resources? To get for example, medical specialists, and qualified travel agents with the necessary experience for my situation, etc.

8.      Confiscation of Funds Earned or Given to Me.

There have been many times that large amounts of money have been taken by powerful others like members of religious orders (the home I live in is one), family members, a   bank and established thieves.
For example a gentleman offered to give me a gift and asked me what I would like.  I said I live in work in a tiny room and I would like the room decorated so that I could be more comfortable.  A sister of the order was there and she said I could not ask for this.  She then asked me for a suggestion of what I would like to do with the money. Unfortunately, since this was not my choice, I asked for an improved children’s pool which would make the sisters very popular with the community. The problem repeats itself throughout the years. The money went to the pool years ago, someone I do not know at all took the credit for the gift, and to this very day I live and work in a very crowded miniscule room. Meanwhile for years large sums of money continue to come in for the pool and parks connected to it. When the opportunity presented itself it was siphoned into a politically popular move for the order and nothing at all was done to solve my personal situation. Not only that, the opportunity like that does not come for me often and I am more and more unable to speak.
The standard response to any complaint I manage to get out is that you should not complain because the park was made for you. 
And I approach old age rapidly.
This document has a list of the many things that still are not taken care of and if the money is directed elsewhere, they never will be.

Question:  Can the notary state clearly that if money is destined for me then it should not be taken by any other person or order? That money destined for me should be first and foremost be used by me according to my wishes and needs?

 
ANNEXE

Preventing future attacks

(I find myself at this time, relatively free from violent attacks.  It is however a situation that is very prominent at all levels very close to me and still. Self defence, and actually, freedom from violent encounters is a task that I have the time and the need to preoccupy myself with. )

The past attacks by family members and the high level of competiveness among family members can only lead me to assume and seeing, unless controlled, will occur again. Especially if money is involved.  
My name since childhood has been (Unnamed) but the family that has used the name for decades did not have this name.  Our relationship is not based on deep family roots
The attacks on myself for personal gain by surrogate family members include:
·         Being brainwashed to accept these people as my family members with the family name.
·         Kidnappings to maximum security prisons in the USA
·         An attempt to confine me in room until I starve to death.
 
1.      Can a mandate include regulations to deal with any incidences of this in the future?
2.      Can the will have a clause on the event of any violent attack whether successful or not, perpetuated on me by a family member of a supporter of the family.
